Вакансія: Business Environment Legal Expert

The Investment for Business Resilience (IBR) Activity (formerly known as FSR) is a five-year program funded by the United States Agency for International Development (USAID) and implemented by DAI Global LLC. The purpose of the IBR Activity is to support systemic changes in Ukraine’s economy and increases the supply of finance available to Ukrainian businesses. IBR aims to transform the country’s financial sector into a well-functioning and competitive market that is aligned with European Union standards and integrated into international financial systems, while directly providing financing to enterprises for sustained economic growth.

The IBR is looking for candidates to fill in the Business Environment Legal Expert position, LTTA in Kyiv.

PURPOSE OF THE ROLE:

The Business Environment Legal Expert will support analysis, development and implementation of the legal and regulatory framework aimed at improvement of business environment in Ukraine to ensure resilience of Ukrainian enterprises and facilitate post-war economic recovery, and bring it in line with the EU legislation to the extent applicable.

OBJECTIVES AND DUTIES:

  • Conduct legal analysis of the legal and regulatory framework affecting business environment in Ukraine (covering corporate, tax, customs and commercial (trade) matters).
  • Provide recommendations on improvement of legislation in the mentioned areas, assist in developing regulations, concepts and roadmaps.
  • Work the regulators, markets participants and other stakeholders on regulatory barriers identification and removal.
  • Engage with the Ministry of Economy, Ministry of Finance, State Tax Service and other GoU authorities, the Rada Committees to provide technical assistance on the drafting, commenting, and promoting legislation and regulations.
  • Conduct analysis of the guidelines and best international practices and implementation them in Ukrainian legislation.
  • Provide input into the development of laws and regulation to approximate Ukrainian legislation to EU Directives and Regulations, and other international standards as applicable.
  • Provide regular monitoring of legislation, draft laws and updates; inform on the legal and regulatory news affecting business environment.
  • Work with the local and international experts, other donor organizations to ensure coordinated legal response.
  • Work with other components of the IBR to ensure legal accuracy and compliance.
  • Perform other related duties as assigned by the Supervisor.

QUALIFICATIONS:

  • University degree in law; advanced degree preferred.
  • Extensive knowledge of Ukrainian business operational challenges, minimum five (5) years’ working experience, experience of providing the general legal support to Ukrainian business entities would be an advantage.
  • Understanding of the legal and regulatory framework covering corporate, tax, customs and commercial (trade) matters, relevant EU Directives, experience in approximation of the Ukrainian legislation with that of the EU would be an advantage.
  • Experience in legal drafting, commenting legislative acts.
  • Experience with research, writing analytical/assessment reports.
  • Strong communication and presentation skills.
  • Excellent oral and written English and Ukrainian skills.
