Background

The allegations of atrocities and human rights violations in Ukraine are extensive, including accounts of conflict-related sexual violence (CRSV), the breadth of which remains difficult to fully assess, notably due to stigma and limited access to services as a result of the prevailing security situation. It is in this context that the Special Representative of the Secretary General on Sexual Violence in Conflict (SRSG-SVC) travelled to Ukraine on 2 May 2022 to sign a Framework of Cooperation (FoC) with the Government of Ukraine, on behalf of the United Nations system, on the prevention and response to CRSV. The FoC outlines five overarching areas of cooperation including: (i) Strengthening rule of law and accountability as a central aspect of deterrence and prevention of crimes of sexual violence; (ii) Strengthening the capacity of the security and defense sector to prevent sexual violence; (iii) Ensuring that survivors of sexual violence, as well as their children, have access to comprehensive services; (iv) Ensuring that sexual violence is addressed in the framework of a ceasefire agreement; (v) Addressing conflict-related trafficking in persons for the purposes of sexual exploitation/prostitution, given the acute vulnerability of the millions of civilians, predominantly women and children, who have become internally displaced or have been forced to flee across Ukraine’s borders. 

Through a consultative process, an Implementation Plan was developed to guide action on each pillar of the FoC, in a holistic manner. The Implementation Plan will ensure that the national capacity to investigate and prosecute allegations of wartime sexual violence is enhanced through coordination with first responders and that the specialized unit within the Office of the Prosecutor General is established. It will ensure that comprehensive services and effective referral pathways are in place; that security actors are trained to respect and enforce zero-tolerance policies; and measures are taken to mitigate the risk of human trafficking. On 22 September 2022, the Implementation Plan was validated by the Commission for the Coordination of Interactions of the Executive Bodies to Ensure Equal Rights and Opportunities for Women and Men. In addition, in October 2022, the Ukrainian Office of the Prosecutor/CRSV Unit lunched a strategy on the prosecution of CRSV crimes. An Action Plan to guide its implementation is currently being drafted. 

United Nations Team of Experts on the Rule of Law and Sexual Violence in Conflict

The United Nations Team of Experts on the Rule of Law and Sexual Violence in Conflict (TOE) was created by Security Council resolution 1888 (2009) to assist national authorities in strengthening the rule of law, with the aim of ensuring criminal accountability for perpetrators of CRSV. 

In line with its mandate and the FoC, the Team of Experts has been engaging with the Government of Ukraine to ensure a survivor-centred approach to accountability for CRSV crimes. In order to further assist the implementation of the accountability pillar of the Implementation Plan for the FoC and the Action Plan for the CRSV Strategy, and to enhance the capacity of the Ukrainian Office of the Prosecutor on CRSV, the TOE aims at deploying a Technical Specialist on Judicial Affairs and Conflict-Related Sexual Violence in Ukraine.

The Technical Specialist on Judicial Affairs and Conflict-Related Sexual Violence will be based in Kyiv, Ukraine. He/she will be under the dual supervision of the Team Leader of the TOE based in New York and the UNDP Access to Justice Adviser. He/She will be managed administratively by the Deputy Resident Representative. 

Duties and Responsibilities

Under the supervision of the TOE and UNDP, and in coordination with, the Ukrainian Office of the Prosecutor on CRSV and other rule of law partners, the Technical Specialist will:

  • Regularly coordinate with the Senior Women’s Protection Adviser and the TOE co-lead entities at the country level to assist national authorities in the implementation of the outcomes identified under the Accountability and Access pillar of the Implementation Plan for the FoC, and the Action Plan for the CRSV Strategy.
  • Provide technical advice and mentoring to Ukraine institutional actors to promote the timely investigation and prosecution of CRSV crimes, including on: developing investigation plans; interviewing victims and witnesses; interviewing suspects; supporting victims, including by ensuring the adoption and implementation of appropriate protective measures for victims and witnesses; gathering and safeguarding evidence, facilitating efficient and effective coordination between investigators, magistrates and other relevant parties to the process; promoting fair trial standards; and preparing cases for prosecution.
  • Provides expertise in designing and implementing trainings, provision of technical support and other capacity development methods for national justice and law enforcement professionals responsible for processing CRSV cases.
  • Support legislative reform processes, including the drafting of laws, decrees or other regulations and provide substantive advice on CRSV crimes and advocate for the consistent integration of a victim-centered approach and a gender perspective into any such laws, decrees, or regulations.
  • Assist national authorities to identify expertise and institutional gaps on reparations and trafficking in the context of CRSV.
  • In close consultation with the relevant national stakeholders and UN partners, produce internal quarterly analysis reports on the challenges, as well as on the progress made on the investigation and prosecution of CRSV and providing redress to survivors, highlighting the key challenges and making recommendations on how to address them. 

Perform other duties as required to support the Implementation Plan for the FOC, the ToE’ and UNDP’s mutual partnership, and their assistance to national authorities and stakeholders in Ukraine addressing CRSV in Ukraine.

The incumbent performs other duties within their functional profile as deemed necessary for the efficient functioning of the Office and the Organization.

Required Skills and Experience:

Education:

  • Advanced university degree (Master’s degree or equivalent) in law is required.
  • A first-level university degree (Bachelor’s degree) in law in combination with 2 additional years of qualifying experience, will be given due consideration in lieu of Master’s degree.

Experience:

  • Minimum 7 years with Master’s degree or 9 years with Bachelor`s Degrees of progressively responsible experience working on criminal law including sexual crimes is required. 
  • Experience in conducting or supporting the investigation and prosecution of serious international crimes is desirable.
  • Experience working on conflict-related sexual violence is desirable.
  • Experience in providing technical advice to national judicial institutions is desirable.
  • Experience working with the United Nations system is an asset.
  • Fluency in English is required. Knowledge of Ukrainian is an asset.
  • Knowledge of MS Office package is required (Excel, Word, PowerPoint, Internet, etc.)

Evaluation of qualified candidates will include an assessment exercise, followed by a competency-based interview, and subject to reference checks.
