The ultimate objective of the EU-funded IOM-implemented project “Support for Migration and Asylum Management in Ukraine” (IMMIS), within which the Consultant will operate, is to contribute to enhancing migration management in Ukraine through the development of institutional and technical capacities of the migration management bodies, particularly the State Migration Service of Ukraine (SMS) and the State Border Guard Service of Ukraine (SBGS).

Under the overall supervision of the IOM Chief of Mission, direct supervision of the Project Manager and the overall coordination and oversight of the CBMM Programme Coordinator, the Consultant will implement the IMMIS project tasks related to the provision of support to SMS in developing and introducing a number of anti-corruption measures in compliance with the Law of Ukraine “On Prevention of Corruption”, the Law of Ukraine “On Civil Service”, the overall Public Administrative Reform (PAR) and other relevant documents.

The expert will work in close coordination with IOM Technical Focal Points for Human Recourse Management (HRM) and Trainings and will serve the main focal point for the IMMIS project team on anticorruption issues, related to SMS activities.

Background of the Consultancy:

To strengthen the public administration sector and to provide immediate support to implementation of key reforms in Ukraine, it was agreed with international donors to establish Reform Support Teams (RST) to be embedded in respective state authorities of Ukraine.

A Reform Support Team (RST) is a group of Ukrainian professionals (non-public servants) funded on a temporary basis by the donors that provides targeted technical support and assists Ministries and public services/agencies in the design and implementation of sectorial strategies and priority reforms.

The specific objective of RSTs is to support the implementation of urgent reforms, included in respective Action Plans of beneficiary state authorities, through joint work alongside civil servants on related actions. The staff of Ministries and other bodies of state administration, bearing the combined burden of ongoing operations and simultaneous reforms, will benefit from strengthened capacity while deployment of external, qualified local professionals fully focused on reform processes will result in their accelerated pace.

RST members will neither substitute nor be involved in routine government work as they will focus exclusively on transitional activities in support of reforms. 

The RST will be located within the organizational structure of the relevant beneficiary institution as a standalone structure on a temporary basis.

Such RST will also be deployed for SMS, and it will consist of four experts, including a Delivery Manager, an Anti-Corruption Expert, an IT expert, and a Legal expert.

 Objective:

The main objective of the assignment of the Anticorruption expert is to strengthen the capacity of SMS by developing and introducing a number of anti-corruption measures in compliance with the Law of Ukraine “On Prevention of Corruption”, the Law of Ukraine “On Civil Service”, the overall Public Administrative Reform (PAR) and other relevant documents.

 Specific Functions

  1. To support the company, subcontracted by IOM, in analysis and then reengineering of the selected migration management business processes (in anticorruption aspects) – by end of April 2018
  2. To follow the developments in anticorruption legislation of Ukraine and properly inform SMS and IOM about any developments – on monthly basis
  3. To study European experience and best practices on organization of work in state authorities with those who reveal corrupt officials; presentation of the findings to SMS and recommendations on their incorporation – by mid-January 2018
  4. To study European experience and best practices on practical aspects of development and implementation of anticorruption programmes by state authorities. Presentation of the findings to SMS and recommendations on their incorporation – by mid-February 2018
  1. To develop recommendations on improvement of preventive anti-corruption measures among SMS staff and consumers of administrative services, provided by SMS – by mid-March 2018
  1. In coordination with IOM Technical Focal Point for Trainings, to develop a training plan for SMS staff on “Prevention of and counteraction to corruption in SMS” – by mid-February 2018
  1. To conduct trainings for SMS staff on best anti-corruption practices – second half of February and April 2018
  1. Participate in regular IMMIS project working group meetings, devoted to SMS HRM issues – on regular basis.
  1. To submit to the Delivery Manager monthly reports, describing performed activities and achieved results.

Tangible and measurable outputs of the assignment (expected to be delivered during the six months’ duration of the Contract)

  1. A list of European/international best practices on organization of work in state authorities with those who reveal corrupt officials; presentation of the findings to SMS and recommendations on their incorporation – by mid-January 2018
  2. A list of European/international best practices on practical aspects of development and implementation of anticorruption programmes by state authorities. Presentation of the findings to SMS and recommendations on their incorporation – by mid-February 2018
  1. A list of recommendations on improvement of preventive anti-corruption measures among SMS staff and consumers of administrative services, provided by SMS – by mid-March 2018
  1. A training plan for SMS staff on “Prevention of and counteraction to corruption in SMS”, developed in coordination with IOM Technical Focal Point for Trainings – by mid-February 2018
  1. At least two trainings for SMS staff on best anti-corruption practices – second half of February and April 2018
  2. At least six monthly briefings for SMS and IOM on legal developments in anticorruption sphere related to migration management
  3. Six monthly reports, describing performed activities and achieved results, which shall be submitted to the Deliver Manager, coordinating the work of SMS RST, for his/her approval and further submission to SMS, IOM and EU Delegation.

 

Qualifications and Experience

Education

  • University degree in law or social science.

Experience

  • At least five years of professional work experience in anti-corruption sphere
  • Experience in conducting assessments and analyzing their results
  • Significant knowledge of European and international best practices in preventing of and counteraction to corruption
  • Experience in law-drafting
  • Experience in strategic planning and implementation of anticorruption measures.
  • Experience in cooperation with state authorities

Languages

  • Fluency in Ukrainian; knowledge of English would be an advantage.
