The objective of this project is to enable transformation of market for investments in EE in public buildings in the country, by using Energy Service Company (ESCO) modality, utilizing Energy Performance Contract (EPC), facilitated by introducing a single nationwide energy management information systems (EMIS) for Ukraine. The project has four main components, as follows:
- Component 1: Formulation and introduction of a streamlined and comprehensive legal/regulatory, and policy framework for promoting energy efficiency in public buildings..
- Component 2: Promotion of private investment in energy efficiency in public buildings through appropriate catalytic financial incentives.
- Component 3: Demonstration of the implementation of EPC modality for energy efficiency initiatives in public buildings in different cities/municipalities.
- Component 4: Establishment and operationalization of a National Energy Management and Information (NEMIS) and a NEMIS Database.
Under its Component 1, the Project is to establish a streamlined and comprehensive legal and regulatory framework including secondary legislation to promote energy efficiency in public buildings through strengthening of monitoring and enforcement mechanisms and ESCO market development.
To this end UNDP is seeking for the knowledge champion in the field of energy efficiency legislation who will lead the activities under the Component 1 of the Project.
Duties and Responsibilities
Under the supervision of the Project Manager, and under the guidance of the Chief Technical Advisors on ESCO and EMIS – the Energy Efficiency Policy Analyst will:
- Lead, manage and coordinate the activities of the Project related to legislation framework in the fields of Energy Efficiency, ESCO and Energy Management and Monitoring.
- Coordinate activities of consultants that provide legal expert support to partner municipalities, technical working groups and other relevant stacke-hoders of the Project.
- Provide support related to the development (drafting) of primary and secondary legislation (regulations) to support the development of the ESCO market in Ukraine;
- Maintain liaison with State Agency on Energy Efficiency and Energy Savings of Ukraine, National Bank of Ukraine and other relevant governmental bodies on design and introduction of legislative framework in fields of ESCO and Energy Management and Monitoring.
- Promote the Project’s legislative initiatives in the Government and the Parliament.
- Identify the legislative barriers on National and Municipal levels and provide the recommendations to overcome it.
- Collaborate with municipalities (and/or asset holder entities – e.g. municipal department of education or health care etc.) to agree the scope of legal advice and support services required in term of EPC contracting.
- Provide tailored legal advice on all aspects of energy /utilities law (including the Law of Ukraine «On introducing new investment opportunities, guaranteeing rights and legal interests of businesses entities for conducting large-scale energy modernization» and Energy Efficiency Directive 2012/27/EU of the European Parliament and of the Council of 25 October 2012), construction law, procurement/tender law, environmental law and corporate law related to establishing municipal ESCO company.
- Consolidate existing practices, rules and regulations while clarifying the best option for implementing energy efficiency projects in public buildings.
- Perform extensive legal research and analysis and prepare legal opinions on legal issues (including complex or novel) arising from planning and implementation of energy efficiency projects in public buildings.
- Provide necessary inputs and support to the intergovernmental technical working group on creation of institutional and legal basis for National informational energy – management system.
- Coordinate, guide and manage on request from project manager individual contractors, experts and consultants in legal and policy formulation tasks;
- Provide advice on other relevant issues as might be required.
- Undertake other duties that contribute to the effective implementation of the Project.
Institutional Arrangement:
Under the supervision of the Project Manager and under the guidance of the Chief Technical Advisors on ESCO and EMIS, the Energy Efficiency Policy Analyst is fully responsible for implementation of Component 1 of the Removing Barriers to increase investment in Energy Efficiency in Public Buildings in Ukraine through the ESCO modality in Small and Medium Sized Cities project according to the project document, and UNDP corporate rules and procedures.

Required Skills and Experience
Education:
- Master’s degree (or equivalent) in Economics, Public Administration, Project Management, Law, Environment, preferably related to legal aspects or other relevant field.
- Bachelor`s degree in a related field with additional 2 years of relevant experience can be accepted in lieu of Master’s degree.
Experience:
- Minimum 2 years (withy Master’s degree) or 4 years (with Bachelor’s degree) of relevant professional experience in the practice of law with Governmental bodies, law firm or a municipality.
Required Languages:
- Fluent written and spoken English, Russian and Ukrainian.
Required skills:
- Experience with policy making and legislation drafting in energy sphere;
- Experience with the ESCO business model and EPC contracts is required.
- Understanding of the key issues faced by organization involved in energy and utilities sector, the political and regulatory background and the nature of work involved
Desired skills in addition to the competencies covered in the Competencies section:
- Excellent analytical, advisory, communication and writing skills is and advantage;
- Strong background in energy law and energy projects is desired;
- Proven prior experience (of professional or advisory services to the Government (or national level counterparts) and/or reputable international organizations is a strong asset;
- Proficiency in use of office software packages (MS Word, Excel, etc.) and advance knowledge of spreadsheet and database packages, experience in handling of web based management systems is an advantage.
