The Financial Sector Reform Activity (FSR) in Ukraine is a five-year program funded by the United States Agency for International Development (USAID) and managed by DAI Global LLC (DAI). The purpose of the activity is to transform the country’s financial sector into a sophisticated, well-functioning, competitive market that is aligned with European Union (EU) standards and integrated into international financial systems. This transformation will mobilize private finance for sustained economic growth in Ukraine.

The FSR is looking for candidates to fill in the following short-term (consultant) positions under Component 1: Market Regulation and Supervision:

1. Local Legal Specialist on Cross-Border Trade Transactions in Public Procurements

 Short description of Objectives and Duties:

•  Advice on implementation of (i) Directive 2014/24/EU of the European Parliament and of the Council of 26 February 2014 on public procurement, (ii) Directive 2014/25/EU, and (iii) Directive 2014/55/EU of the European Parliament and of the Council of 16 April 2014 on electronic invoicing in public procurement.
• Draft legislative amendments to the Law of Ukraine “On Public Procurements” and other legislative acts driven by the implementation of the Procurement Directives in Ukraine.

Required Qualifications:

• Higher educational degree in Law, Masters is a preference.
• At least 7 years of legal experience in cross-border trade operations and public procurement in Ukraine.
• Experience in working with the public procurement procedures in the EU.
• Experience in drafting Ukrainian legislative acts and/or amendments to Ukrainian legislative acts. 

2. Local Legal Specialist on Financial Consumer Protection

Short description of Objectives and Duties: 

• Advice on status of existing legislative initiatives in the protection of financial services consumers’ rights in Ukraine with recommendations.
• Advice on the best international practices and initiatives. 

Required Qualifications: 

• University Higher educational degree in Law, Masters is a preference.
• At least 5 years legal or financial experience in financial services consumers’ rights. 

3. International Regulatory Expert on Capital and Organized Commodity Markets

 Short description of Objectives and Duties: 

• Advice on bringing the practices of application and interpretation of the Ukrainian laws and regulations, supervision, and enforcement (“supervisory practices”) by the National Securities and Stock Market Commission in line with the practices of EU regulators.
• Analysis of activities by the European Securities and Markets Authority (ESMA) aimed at promoting a common supervisory culture and consistent supervisory practices across the EU (“supervisory convergence”).
• Benchmarking supervisory practices of the National Securities and Stock Market Commission in capital and organized commodity markets with the practices of EU regulators, including identifying material inconsistencies in approaches, planning, prioritization, methodologies and procedures of supervisory practices.
• Recommendations of necessary changes to the legislative and supervisory framework of Ukraine driven by the improper implementation of the EU acquis and the supervisory practices inconsistent with the practices of EU regulators.

 Required Qualifications: 

• Higher educational degree in Law, Masters is a preference.
• At least 5 years of experience in the legal sphere related to capital and organized commodity markets.
• Experience in working within the capital and organized commodity markets sphere in the EU is strongly preferred.

All positions require:

• Fluency in Ukrainian and English;
• Strong communication, analytical, and presentation skills;
• Knowledge of Microsoft Office.
