Тендер на закупівлю юридичних послуг щодо укладення зовнішньоекономічних договорів

Програма USAID «Конкурентноспроможна економіка України» (КЕУ), що втілюється компанією Кімонікс Інтернешнл Інк., запрошує кваліфікованих постачальників подати на розгляд свої пропозиції щодо закупівлі юридичних послуг щодо укладення зовнішньоекономічних договорів для малих та середніх підприємств (надалі – МСП), що розпочинають експорт чи виходять на нові експортні ринки, як зазначено в Оголошенні про тендер CEP-PAR-2023-039

Будь ласка, зверніть увагу на наступні важливі положення тендеру:
- кінцевою датою подачі пропозицій є 18:00 за київським часом, 17 жовтня 2023 року;
- всі запитання щодо умов тендеру мають бути надіслати не пізніше ніж 18:00 за київським часом, 10 жовтня 2023 року;
- вся комунікація щодо тендеру відбувається виключно в письмовій формі за адресою [email protected];
- технічні та цінові пропозиції подаються українською або англійською мовою;
- Програма USAID «Конкурентоспроможна економіка України» (КЕУ) звільняється від сплати податків, зборів та ПДВ країни-партнера. Відтак, КЕУ буде оплачувати вартість послуг/товарів без ПДВ.
УВАГА! 06 жовтня 2023 року було внесено зміни до RFQ CEP-PAR-2023-039, а саме до форми цінової пропозиції.

Can we propose another approach to providing the services that one is described in the Section 3 of the RFQ (more effective in our opinion)?
Namely, in order to reach the results prescribed by the RFQ in an effective way we would propose preparation of one foreign economic contract template and its further adaptation to commercial conditions of each SME. Or should the legal consultant provide the services only in the form of legal analysis of the draft agreements, which will be prepared and provided by SMEs?

In which language the SME’s contracts will be prepared?

Does scope of services under the RFQ include translation services for bilingual contracts?

CEP expects that the analysis of bilingual contracts will not include translation services and shall be given in the form of advice as described in the RFQ. |

In which language comments and consultations shall be provided according to the RFQ?

According to the RFQ, the consultants will be expected to collect data on key indicators (new jobs, export sales, investments, and new export markets) and provide regular reports to the USAID CEP Program until October 1, 2025. Considering this, should the fee for reviewing a foreign economic contract also include the fee for collecting data on key indicators and preparing relevant reports? Or may the legal consultant propose in the price quotation the fee for mentioned services separately?

On page 12 of the RFQ there is the table that provides the format for providing information on the services to be provided by the legal consultants upon request. Asper the table, 300 contracts are planned to be reviewed by the legal consultants, however the total price – for 100 of such services.

Could you please clarify the expected total amount of the contracts to be reviewed, which shall be taken into consideration for the price quotation?

Please confirm our understanding that the services included in RFQ prescribe no communication with the SME’s counterparties, neigher adjusting of the agreements for each transaction and/ or buyer of the goods.

Please confirm our understanding that the templates of the agreements prepared/ reviewed by the consultant may be published at the web-sites of the SMEs as public offer.

This is not something that is expected under the RFQ. |

Do we understand correctly that the remuneration of the consultant will be paid upon expiration of the 6-th months term of the validity of the contract and will depend on the exact number of the draft agreements reviewed/ prepared?

This will be further agreed in the contract with the consultant and subject to changes. |
